Terms of Use

01 · Agreement

These Terms of Use (“Terms”) govern your access to and use of the Decishape iOS application and the website at decishape.com (together, the “Service”). The Service is operated by an individual developer based in Ukraine, doing business as “Decishape” (“Decishape,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. You also acknowledge that your personal data will be handled in accordance with our Privacy Policy. If you do not agree, do not use the Service.

02 · Eligibility

The Service is rated 17+ and intended for adults. You must be at least the age of majority in your jurisdiction (and no younger than 18) to create an account and make purchases. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

03 · License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Decishape app on Apple-branded devices that you own or control, for your own personal, non-commercial use, consistent with the Apple Media Services Terms and the Usage Rules in the App Store.

04 · Account

You access Decishape using Sign in with Apple. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from Settings → Delete Account.

Decishape offers premium features through auto-renewing subscriptions and a one-time lifetime purchase, all processed by Apple through In-App Purchase. Current offerings include:

• Monthly — an introductory price for the first month, then the standard monthly rate, billed every month.
• Annual — billed once per year, including a 7-day free trial for eligible new subscribers.
• Lifetime — a single one-time payment for ongoing access; not a subscription.

Prices are shown in the app and may vary by region and over time. The exact title, price, and billing period are displayed at the point of purchase and confirmed before you buy.

Auto-renewal

Auto-renewing subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period. Payment is charged to your Apple ID at confirmation of purchase.

07 · Trials

If you start a free trial or introductory offer, any unused portion of the trial is forfeited when you purchase a subscription, where applicable. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription and your Apple ID will be charged the standard price. Eligibility for trials and introductory pricing is determined by Apple and is generally limited to new subscribers.

08 · Cancellation

You can manage or cancel your subscription at any time in Settings → [your name] → Subscriptions on your Apple device. Cancellation takes effect at the end of the current billing period, and you keep access until then.

All purchases are processed by Apple, and refunds are handled by Apple in accordance with the Apple Media Services Terms. Decishape generally cannot grant refunds directly. To request a refund, visit reportaproblem.apple.com. You can restore previous purchases at any time using Restore Purchases in the app.

09 · Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app, except as permitted by law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
• Use the Service to violate any law or infringe the rights of others.
• Resell, sublicense, or commercially exploit the Service without our written permission.
• Circumvent or tamper with billing, entitlements, or usage limits.

10 · IP

The Service, including its software, design, the Decishape name and logo, the Direction Score methodology, and all related content, is owned by Decishape and protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you. You may not use our trademarks without prior written consent.

11 · Your content

You retain ownership of the entries and notes you create (“Your Content”). You grant us only the limited license needed to host, process, back up, and display Your Content to you and to operate the Service's features (such as computing your scores and syncing across your devices). We do not claim ownership of Your Content and do not use it for advertising. You are responsible for the accuracy of what you enter.

12 · Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any insight, score, or projection will be accurate or achieve any particular result. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

13 · Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECISHAPE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

14 · Indemnity

You agree to indemnify and hold harmless Decishape from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

15 · Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.

16 · Apple

These Terms are between you and Decishape only, not with Apple. Apple is not responsible for the Service or its content. To the maximum extent permitted by law, Apple has no obligation to furnish maintenance or support for the app.

• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation regarding the app.
• Apple is not responsible for addressing any claims relating to the app, including product-liability, legal/regulatory non-compliance, or consumer-protection claims.
• Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes intellectual-property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

These Terms constitute a custom End User License Agreement (EULA) that replaces or supplements Apple’s Standard EULA where applicable.

17 · Third parties

The Service relies on third-party services to operate, including Apple (authentication, distribution, and payments), our hosting and infrastructure providers, and analytics, attribution, and measurement providers that help us understand how the app is discovered and performs. Some features may also use referral or deep links provided by these services. Your use of the Service may be subject to those providers’ own terms, and we are not responsible for their acts, omissions, products, or services. The data processed through these providers is described in our Privacy Policy.

18 · Law

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules, except where your local consumer-protection laws require otherwise. You agree to resolve any individual disputes in the courts of Ukraine, unless mandatory local law grants you the right to bring proceedings in your home jurisdiction.

Class Action Waiver: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND DECISHAPE AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. This means you waive your right to participate as a class representative or class member in any class-wide legal claim against Decishape.

19 · Updates

We may update these Terms from time to time. When changes are material, we will update the “Last updated” date and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
