Terms of Use

01 · Agreement

These Terms of Use (“Terms”) govern your access to and use of the Decishape iOS application and the website at decishape.com (together, the “Service”). The Service is operated by an individual developer based in Ukraine, doing business as “Decishape” (“Decishape,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. You also acknowledge that your personal data will be handled in accordance with our Privacy Policy. If you do not agree, do not use the Service.

02 · Eligibility

The Service is intended for adults. You must be at least 18 years old to use the Service. By using the Service you represent that you are 18 or older and that the information you provide is accurate. If you are under 18, do not use the Service.

03 · License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Decishape app on Apple-branded devices that you own or control, for your own personal, non-commercial use, consistent with the Apple Media Services Terms and the Usage Rules in the App Store.

04 · Account

Decishape requires an account. You sign in using Sign in with Apple or Sign in with Google. These create separate accounts: signing in with one will not open an account created with the other.

You are responsible for maintaining the security of whichever sign-in account you use, and for all activity that occurs under your Decishape account. Notify us promptly of any unauthorized use.

You may sign out or delete your account at any time, including directly from the subscription screen before you purchase anything. Deleting your account permanently removes your entries and your record from our systems; it is not a deactivation, and it cannot be undone. You may sign up again afterwards with the same email address, but your previous record will not return.

Deleting your Decishape account does not cancel a subscription billed by Apple. See Cancellation & refunds below.

06 · Billing

Decishape is a paid app with no free tier. Access to the app requires a Decishape Premium subscription or the one-time Lifetime purchase. All plans are sold and processed by Apple through In-App Purchase.

What the subscription provides

A Decishape Premium subscription provides full access to the app for the duration of the subscription period: the daily check-in and Direction Score, Course and its projections, the Compass decision tools, Insights, Hold, widgets, the Apple Watch app, notifications, data export, and the Direction Report. Features that require a minimum number of your own entries become available as you reach them; this is a property of the product, not a separate purchase, and no feature is sold separately.

Plans and prices

Prices shown are for the United States storefront and are inclusive of applicable taxes where required. Prices may differ by region and may change over time; the title, price, and billing period that apply to you are always displayed in the app and confirmed by Apple before you buy. If we increase the price of an existing subscription, Apple will ask for your consent before the increased price takes effect, and your subscription will not renew at the higher price without it.

The Lifetime purchase is a one-time payment and is not a subscription: it does not auto-renew, and there is nothing to cancel. It grants access for as long as the Service is operated.

07 · Trials

The Annual plan includes a 7-day free trial for eligible new subscribers. The Monthly plan instead offers an introductory price of $4.99 for the first month and does not include a free trial.

Unless you cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription and your Apple Account will be charged at the standard price shown above. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable. Eligibility for trials and introductory pricing is determined by Apple and is generally limited to new subscribers; a previous trial or introductory offer on the same Apple Account may make you ineligible for another.

08 · Cancellation

You can manage or cancel your subscription at any time in Settings → [your name] → Subscriptions on your Apple device. Cancellation takes effect at the end of the current billing period, and you keep access until then. No cancellation of the current period is available once it has begun.

Deleting your Decishape account does not cancel your subscription. Account deletion removes your data from our systems; the subscription is a separate agreement billed by Apple and will continue to renew until you cancel it as described above.

All purchases are processed by Apple, and refunds are handled by Apple in accordance with the Apple Media Services Terms. Decishape generally cannot grant refunds directly. To request a refund, visit reportaproblem.apple.com. You can restore previous purchases at any time using Restore Purchases in the app.

Nothing in these Terms limits any statutory right of withdrawal, cancellation, or refund available to you as a consumer under the laws of your country of residence.

09 · Referrals

Decishape may offer a referral programme in which sharing your personal code grants premium access time to you and to the person who redeems it. Referral credit is a promotional grant made by us, not a purchase processed by Apple.

• Referral credit has no cash value, cannot be exchanged, transferred, or refunded, and is not a substitute for a subscription.
• Credit is granted separately from any Apple subscription and does not extend, pause, or alter a subscription billed by Apple.
• We may withdraw credit obtained through abuse — for example by creating accounts solely to redeem your own codes, or by redeeming codes through automated means.
• We may change or end the programme at any time. Credit already granted will be honoured for its stated duration.

10 · Health data

If you grant permission, Decishape reads a limited set of Apple Health data — sleep and step counts — to display alongside your own entries as context.

• Health data is read on your device only and is never transmitted to our servers.
• It is never used to calculate your Direction Score or any other figure the app produces.
• It is never used for advertising or marketing, and is never shared or sold.
• The app is fully functional without it. You can withdraw permission at any time in Health → Sharing → Apps → Decishape.

11 · Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app, except as permitted by law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
• Use the Service to violate any law or infringe the rights of others.
• Resell, sublicense, or commercially exploit the Service without our written permission.
• Circumvent or tamper with billing, entitlements, or usage limits.
• Abuse the referral programme — for example by creating accounts solely to redeem your own codes, or by redeeming codes through automated means.

12 · IP

The Service, including its software, design, the Decishape name and logo, the Direction Score methodology, and all related content, is owned by Decishape and protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you. You may not use our trademarks without prior written consent.

13 · Your content

You retain ownership of the entries and notes you create (“Your Content”). You grant us only the limited license needed to host, process, back up, and display Your Content to you and to operate the Service's features (such as computing your scores and syncing across your devices). We do not claim ownership of Your Content, do not use it for advertising, and do not use it to train machine learning or artificial intelligence models. You are responsible for the accuracy of what you enter. You can export your entries at any time from within the app.

14 · Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any insight, score, or projection will be accurate or achieve any particular result. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

15 · Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECISHAPE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD.

16 · Indemnity

You agree to indemnify and hold harmless Decishape from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

17 · Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. If we discontinue the Service, we will give reasonable notice where we can, and you will be able to export your entries before access ends. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.

18 · Apple

These Terms are between you and Decishape only, not with Apple. Apple is not responsible for the Service or its content. To the maximum extent permitted by law, Apple has no obligation to furnish maintenance or support for the app.

• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation regarding the app.
• Apple is not responsible for addressing any claims relating to the app, including product-liability, legal/regulatory non-compliance, or consumer-protection claims.
• Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes intellectual-property rights.
• Apple must be able to enforce the usage rules set out in the Apple Media Services Terms, and you must comply with them when using the app.
• Apple and Decishape will provide any maintenance and support obligations as described in these Terms; Apple has no such obligation.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government restricted-parties list.
• You must comply with any applicable third-party terms of agreement when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

These Terms constitute a custom End User License Agreement (EULA) that replaces or supplements Apple’s Standard EULA where applicable, and are no less protective of users than that standard agreement. Where these Terms conflict with the Apple Media Services Terms, the Apple Media Services Terms govern your purchase.

19 · Third parties

The Service relies on third-party services to operate, including Apple (authentication, distribution, payments, and push notifications), Google (authentication, if you choose to sign in with Google), our hosting and infrastructure providers, and analytics, attribution, and measurement providers that help us understand how the app is discovered and performs. Some features may also use referral or deep links provided by these services. Your use of the Service may be subject to those providers’ own terms, and we are not responsible for their acts, omissions, products, or services. The data processed through these providers is described in our Privacy Policy.

Where tracking requires your permission, the app asks for it through Apple’s App Tracking Transparency prompt. Declining does not restrict any feature of the Service.

20 · Law

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules, except where your local consumer-protection laws require otherwise. You agree to resolve any individual disputes in the courts of Ukraine, unless mandatory local law grants you the right to bring proceedings in your home jurisdiction.

Class Action Waiver: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND DECISHAPE AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. This means you waive your right to participate as a class representative or class member in any class-wide legal claim against Decishape. This waiver does not apply where it is prohibited by the law of your country of residence.

21 · Updates

We may update these Terms from time to time. When changes are material, we will update the “Last updated” date and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Changes to subscription pricing are handled separately and require your consent through Apple, as described in Subscriptions & In-App Purchases.
